Introduction
The Corporate Manslaughter Bill introduced to Parliament in July 2006 is expected to come in to force sometime in 2007, possibly as early as June, and is the result of years of
debate on the reform of the corporate killing laws. Under the new Bill an organisation will be guilty of corporate manslaughter if the way in which any of its operations are
managed, or in fact organised, by its senior management causes an employees death through a gross breach of their duty of care.
While the penalties for corporate manslaughter are no stricter than existing penalties, the new legislation will make it easier for the Crown Prosecution Service to prosecute large organisations. There is no longer a need to identify an individual "controlling mind" behind the organisation’s activities. Instead the prosecution will now focus on the conduct of the senior management as both individuals and as a collective, thus placing responsibility for ensuring their organisation is safe onto line managers, HR practitioners and health and safety professionals.
