Background
It is widely acknowledged that the statutory procedures which
were set up to encourage early resolution of disputes in
organisations often have the opposite effect. In March 2007, in
response to the current failing bureaucratic system, the
government-commissioned Gibbons Review suggested these
procedures be repealed and replaced with ‘clear, simple, nonprescriptive
guidelines on how to resolve dispute’. The Gibbons
Review implicates mediation as playing a key role in the future of
workplace dispute resolution. Many organisations have already
made the move towards more formalised mediation proceeding,
though many still deal with instances of grievance and dispute
on a more ad-hoc basis.
Instances of dispute and grievance remain pervasive and costly
to most British workplaces. It is therefore crucial that your
organisation has clear and effective policies and procedures in
place to manage disputes when they arise; minimising the
impact on business and people alike, and complying with all
relevant employment legislation.
